Terms and Conditions for Remote Medical Consultation Service

These Terms and Conditions ("Terms and Conditions") govern the relationship and responsibilities between TOKYO FAMILY CLINIC  ("Service Provider" or "We") and Users of the Service ("Customers") in connection with Customers' registration and participation in online consultations with experts/doctors at our Online Clinic via our Website/Fanpage/Zalo/Zoom/Google Meeting… or other methods.

 

1. Explanation of Terms:

  1. "Remote medical consultation" is a form of online advice and consultation provided free of charge through information exchange between our experts/doctors and Customers using online communication tools such as the Website/Fanpage/Zalo/Zoom/Google Meeting… ("Service").
  2. "Advice" refers to information, opinions provided by our experts/doctors during the exchange and consultation with Customers.

2. Important Information:

  1. This service should not be used in life-threatening emergencies or situations where health is compromised and immediate emergency treatment is required (whether occurring before or during the use of the Service).
  2. Not all Customers are suitable for remote medical consultation, and each consultation proposal must be evaluated by us on a case-by-case basis. Our experts/doctors and Customers have the right to discontinue participation in the consultation at any time for any reason considered reasonable, including but not limited to: the need to supplement/replace experts/doctors with more appropriate specialties in the consultation session; Customers agree to switch to using services directly at TOKYO FAMILY CLINIC; Termination of the Remote Medical Consultation Service.
  3. By using the Service, Customers implicitly understand that they have read and fully understood the provisions of these Terms and Conditions and agree to the terms voluntarily.

3. Exclusion of Liability for the Service Provider:

  1. We ensure that our experts/doctors are experienced and reputable in their respective fields, suitable for the diseases or health concerns of Customers to participate in consultations. However, the advice provided by our experts/doctors is for reference only and is specific to the case of Customers based on the information provided by Customers. To clarify, we are not responsible for any liability or commitment regarding the effectiveness of improving the health status of Customers for any advice provided by any experts/doctors.
  2. We acknowledge and maintain the benefits of remote medical consultation for Customers, such as saving time and costs, avoiding the risk of Covid-19 infection due to the need to leave home during outbreaks, etc. However, this service will not guarantee:
    - Replacement for direct visits to healthcare facilities or treatment by Customers' own doctors.
    - The effectiveness and safety of the advice. This depends on the appropriateness, completeness, and honesty of all information provided by Customers and the use of other diagnostic methods as needed on a case-by-case basis.
  3. For advice received, Customers need to assess and consider before making application decisions or related decisions. In addition, Customers will only use advice for themselves and bear all risks in using advice.
  4. Customers are responsible for continuing to maintain and protect information about their health status and privacy, even after sharing it with our experts/doctors and other staff.
  5. Quoting, editing, sharing any information in any form, including but not limited to images, audio, messages, related to the Service performed by Customers and/or third parties (from the provision/disclosure of information by Customers), whether or not the consultation is for Customers, is not permitted unless there is written consent from us.
  6. We have full ownership and use rights to all information generated during Customers' use of the Service. We make no guarantee that the use of such information by Customers will not infringe any patent, ownership, intellectual property rights, or other regulations of ours or third parties.
  7. Our Website and tools used for our Service rely on the infrastructure, connectivity, and services provided by service providers for us. Therefore, Customers accept that the timeliness, continuity, etc., of the Service will partly depend on these service providers. In the event of a technical failure, we will act on behalf and/or support Customers in requesting the above-mentioned service providers to settle related responsibilities in accordance with the law.
  8. The availability and functionality of our Service depend on various situations of both us and Customers, including the location of service usage, mobile phone network availability, internet network availability, signal strength, and the ability of hardware, software, mobile network operators, and telephone and computer servers. Therefore, we do not guarantee that we will meet the service requirements of all Customers and are exempt from liability for limitations in functionality resulting in errors or delays in service implementation.
  9. To maintain and improve the service standards or serve verification, training, scheduling, consultation sessions, post-consultation contacts, we will record, video record, and/or use information, documents, images, etc., provided by Customers in accordance with legal regulations. We commit to protecting Customers' personal information, contact information, diagnosis, treatment, etc., and take appropriate measures to minimize unauthorized access, except in cases of hacking attacks or system errors not due to our fault. However, we bear no legal responsibility for non-compliance with Customers' privacy policies or leakage of Customers' information from storage systems not managed by us or caused by us.
  10. Nurses, medical secretaries, or other staff of ours may be present during the provision of the Service to operate recording equipment, record video, and assist experts/doctors with some other tasks but will perform reasonable procedures to maintain the confidentiality of the information/images obtained.
  11. Furthermore, we are not responsible for any losses to any individuals or organizations if:
    - The injured party is not a Customer of ours; or
    - Customers use or do not use the advice of our experts/doctors; or
    - Customers violate any provisions of these Terms and Conditions.

4. Adjustment, Refusal, Termination, and Suspension of the Service:

  1. We will update the content of these Terms and Conditions and issue any related instructions for the use of the Service as appropriate on our website. Customers understand that the use of their Service must be terminated before the adjustment if Customers do not commit to following the new provisions and instructions.
  2. We reserve the right to refuse, terminate, or suspend the Service when we deem it necessary or ensure compliance with legal regulations, government guidelines, or other state management agencies.

5. Complaints/Litigation:

The contents of these Terms and Conditions are governed and interpreted under Vietnamese law. Any disputes arising in connection with these Terms and Conditions or any disputes arising in connection with the Service may be submitted to the competent courts of Vietnam for resolution.

 

Customers have carefully read and accepted the above Terms and Conditions before submitting a request for us to provide the service.
